1. Acceptance of Terms
By installing or using Revenue Boost (“the App”), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the App.
2. Description of Service
Revenue Boost is a Shopify application that enables merchants to create and display popups, notifications, and lead capture forms on their storefronts. Features include email capture, SMS marketing, cart recovery (via SMS, WhatsApp, and email), gamification popups, social proof notifications, and more.
3. Account and Billing
- You must have an active Shopify store to use the App.
- Billing is handled through Shopify's billing system.
- Subscription fees are billed according to your selected plan.
- SMS and messaging usage may incur additional charges based on volume.
- You may cancel your subscription at any time through Shopify.
4. SMS and Messaging Terms
When using SMS, WhatsApp, or email features, you agree to:
- Obtain proper consent from recipients before sending marketing messages
- Comply with all applicable messaging laws (including TCPA, GDPR, CAN-SPAM, CASL)
- Honor opt-out requests promptly (STOP requests are processed automatically)
- Not send messages containing prohibited content (spam, fraud, illegal goods)
- Accept responsibility for message content and compliance
Violation of messaging compliance may result in immediate suspension of messaging features.
5. Acceptable Use
You agree not to use the App to:
- Violate any applicable laws or regulations
- Send spam or unsolicited communications
- Display misleading or deceptive content
- Interfere with the App's functionality
- Collect data without proper consent
- Send messages to numbers on Do-Not-Call registries
- Engage in any fraudulent or abusive messaging practices
6. Intellectual Property
The App, including its design, features, and code, is owned by Revenue Boost. You retain ownership of your content and campaign configurations. You grant us a license to use your content solely to provide the service.
7. Third-Party Services
The App integrates with third-party services (Shopify, Twilio, Meta WhatsApp, SendGrid). Your use of these services is subject to their respective terms and policies. We are not responsible for third-party service availability or pricing changes.
8. Disclaimer of Warranties
The App is provided “as is” without warranties of any kind. We do not guarantee that the App will be error-free or uninterrupted. Results may vary based on your store, audience, and configuration. Message delivery rates depend on carrier networks and recipient preferences.
9. Limitation of Liability
To the maximum extent permitted by law, Revenue Boost shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the App, including but not limited to messaging delivery failures, compliance issues, or revenue impacts.
10. Termination
We reserve the right to suspend or terminate your access to the App for violation of these Terms, particularly for messaging compliance violations. Upon termination, you must cease all use of the App and your data will be handled per our Privacy Policy.
11. Changes to Terms
We may update these Terms at any time. Continued use of the App after changes constitutes acceptance of the new terms. We will notify you of significant changes via email or in-app notification.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Revenue Boost operates, without regard to conflict of law principles.
